1739 Indenture of Ann Whitten apprenticed to

Elizabeth Gerry, Master Tailor


The transcript of the Indenture reads as follows:-

This Indenture Made the fourth day of September in the thirteenth Year of the Reign of Our Sovereign George the Second by the Grace of God, of Great Britain, France and Ireland, King Defender of the Faith xx and in the Year of Our Lord One Thousand Seven Hundred and thirty nine

between  Ann Daughter of Richard Whitten of Newcastle upon Tyne in the County of Northumberland  of the one part, and Elizabeth Gerry  the Wife of Thomas Gerry of the City of York Merchant Taylor of the other part:  Witnesseth, That the said Ann Whitten hath of her own Free Will and with the Consent of her said father, Put and Bound her self apprentice to and with the said Elizabeth Gerry and with her after the manner of an Apprentice to Dwell, Remain, and Serve from the day of the date hereof for, during and until the Term of Seven Years thence next following be fully compleated [sic] and ended.  During all which Term, the said Apprentice her said Mistress well and faithfully shall Serve, her Secrets shall keep, her lawful Commands shall do, Fornication or Adultery shall not commit, Hurt or Damage to her said Mistress shall not do, nor consent to be done, but she to her Power shall Lett it, and forthwith her said Mistress thereof warn: Taverns or Ale-Houses she shall not haunt or frequent, unless it be about her Mistress’s Business there to be done: At Dice, Cards, Tables, Bowls, or any other unlawful Games she shall not play:  The Goods of her said Mistress shall not waste, nor them lend, or give to any person without her Mistresses Licence: Matrimony with any Man within the Term shall not contract, nor from her Mistress’ Service at any time absent her self: but as a true and faithful Apprentice she shall order and behave her self towards her Mistress and all ??? as well in Words as in Deeds during the said Term: And true and just Accounts of all her Mistress’ Goods, Chattles and Money committed to her Charge, or which shall come to her Hands faithfully she shall give at all times when hereunto required by her said Mistress her Executors, Administrators or Assigns and the said Elizabeth Gerry for and in consideration of the sum of ten Pounds of good and lawful money of Great Britain to her Mistress paid for her self, her Executors, Administrators or Assigns, both Covenant, Promise and Grant by these Presents, to and with the said  Ann Whitten Apprentice, That she the said Mistress her Executors, Administrators or Assigns, shall and will Teach, Learn and Inform her the said Apprentice or caule her to be Taught, Learned and Informed in the mistory or trade of the Merchant Taylor which she the said Mistress now useth after the best Manner of Knowledge, that she or they may or can, with all Circumstances thereunto belonging, and also, shall find, provide to and for her said Apprentice, sufficient and enough Meat, Drink xxxxx and Lodging together with Six Pounds yearly on every Shrove Tuesday during all the said Term as her wages or Salary(?)

 

And for the true Performance of All  and Singular the Covenants and Agreements, either of the Parties aforesaid to bind themselves unto the other firmly by these Presents, In Witness whereof, the parties above-named to these present Indentures, interchangeably have set their Hands and Seals, the Day and Year above-written.

 

NB  What Money or other Thing, is given or contracted for with the apprentice must be inserted in Words at length, and the Duty paid within be time limited to be Stamp Officer, else the Indenture will be void, the Master Forfeit 50 s and ???? Penalty, and the Apprentice will be disabled to follow the Trade, or be made Free etc
